Website Terms of Use

Effective 17 October 2026 · Please read these terms carefully before using this website.

These Website Terms of Use (“Terms”) form a legally binding agreement between you and Incricy AI (“Incricy”, “we”, “us”, “our”), a business registered in the Republic of Kenya. By accessing or using this website, submitting any form on it, or booking a call through it, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the website.

1. About Incricy and this website

Incricy provides AI-powered B2B client-acquisition services, including ideal-buyer research, prospect list building, personalised LinkedIn outreach run from a client’s profile or an Incricy AI Avatar, lead qualification, meeting booking and performance reporting. This website describes those services for information purposes only. Nothing on it is an offer capable of acceptance.

2. Client Service Agreements prevail

Any engagement with Incricy is governed exclusively by a signed Client Service Agreement (“CSA”) and, where applicable, a Non-Disclosure Agreement (“NDA”). The CSA sets out the scope of work, fees, payment terms, deliverables, performance guarantees and their conditions, term and termination. If anything on this website conflicts with a signed CSA or NDA, the signed agreement prevails.

3. Results, case studies and guarantees

Case studies, testimonials, meeting counts, revenue figures and other results shown on this website reflect the experience of specific clients under specific conditions. They are illustrative, not a promise that you will achieve the same outcome. Results depend on factors including your offer, pricing, market, sales process, responsiveness and platform behaviour outside our control. Any performance guarantee applies only as written in a signed CSA, and only where the client meets its obligations under that CSA.

4. Confidentiality

Information you share with us through this website, by email or on a discovery call — including details about your business, clients, pricing, pipeline and strategy — will be treated as confidential and used only to assess and deliver our services to you. We will not disclose it to third parties except to service providers bound by confidentiality, or where required by law. Where a formal NDA is signed, its terms govern. Please do not send highly sensitive information through website forms; we will arrange a secure channel where needed.

5. Personal data and privacy

We process personal data in line with the Kenya Data Protection Act, 2019 and its regulations. Data you submit through our contact survey, Book a Call form or job applications (including CVs) is used only to respond to you, assess fit, deliver services or evaluate your application. Form submissions are transmitted by a third-party email forwarding provider. Candidate data is retained for up to 12 months unless you ask us to delete it sooner. You may request access to, correction of or deletion of your personal data at any time by emailing vallary@incricy.com.

6. Intellectual property

All content on this website — including text, copy, graphics, logos, the Incricy name and marks, page designs, outreach frameworks, scripts, playbooks, methodologies and software — is owned by or licensed to Incricy and protected by copyright and other intellectual-property laws. You may view and print pages for your own internal, non-commercial evaluation of our services. You may not copy, reproduce, republish, sell, adapt or create derivative works from any part of it without our prior written consent. Client and partner logos remain the property of their respective owners and are shown with permission.

7. Acceptable use

You agree not to: use this website for any unlawful or fraudulent purpose; submit false, misleading or another person’s information; scrape, harvest or data-mine the website or its content; attempt to reverse-engineer, copy or replicate our systems, processes or AI agents; introduce viruses or malicious code; attempt to gain unauthorised access to any part of the website or our systems; or use the website to send spam or unsolicited communications.

8. AI-generated content and third-party platforms

Our services use artificial-intelligence tools to draft and personalise communications. Outreach runs on third-party platforms such as LinkedIn, which operate under their own terms and policies and may change features, limits or access at any time. Incricy is not affiliated with, endorsed by or responsible for those platforms, and is not liable for actions they take, including restrictions on any account.

9. Third-party links

This website may link to third-party websites, including client websites, social media and scheduling tools. These links are provided for convenience only. We do not control and are not responsible for their content, availability or privacy practices.

10. Disclaimer

This website and its content are provided “as is” and “as available”. While we work to keep information accurate and up to date, we make no warranties, express or implied, about its completeness, accuracy, reliability or availability, and the website may be updated, changed or interrupted without notice. Nothing on this website is legal, financial or tax advice.

11. Limitation of liability

To the fullest extent permitted by law, Incricy will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, opportunity, goodwill or data arising from your use of, or inability to use, this website or reliance on its content. Our liability in connection with any services is limited as set out in the applicable CSA. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.

12. Indemnity

You agree to indemnify Incricy, its directors, staff and contractors against any claims, losses or costs arising from your breach of these Terms or your misuse of this website.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. The parties will first try to resolve any dispute in good faith through negotiation. If unresolved within 30 days, the dispute will be referred to the courts of Kenya sitting in Nairobi, or to arbitration in Nairobi where a CSA so provides.

14. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when published on this page, as shown by the effective date above. Continued use of the website after a change means you accept the updated Terms.
